Swappie Terms & Conditions – Czech

These Terms and Conditions apply to all orders placed by consumer customers with Swappie on the Swappie Website, including using the Services offered by Swappie on the Website. If You are not a consumer customer, please visit Swappie Business Website. For the Terms and Conditions applicable when selling a Device to Swappie, please click here.

Please read the following Terms & Conditions carefully before placing Your order. If You do not agree with the Terms and Conditions, you cannot place an order. By placing an order, You agree to be bound by the Terms and Conditions set out herein.  

Please note that Swappie sells second-hand devices sourced from various sources. Swappie is not a representative of the Original Equipment Manufacturers (OEM). These Terms and Conditions are concluded solely between You and Swappie, not with the OEMs.

  1. Definitions 

“Swappie” and “We” refers to Swappie Oy, Swappie B.V., Swappie Germany GmbH and Eippa WSOperations OÜ.

“Services” refer to the purchase and sale of Devices and Accessories by Swappie, including order processing, delivery, returns, warranty services, and customer support, as offered through the Swappie Website.

“Website” refers to swappie.com.

“Device”  refers to refurbished smartphones and other electronic devices sold by Swappie that have undergone Swappie’s inspection, testing and refurbishment process.

“Accessory”  refers to earphones, headphones and other accessory products sold by Swappie.

“AirPods” means wireless earphones sold by Swappie as Accessories.

“Order” refers to your purchase of one or more Devices or Accessories through the Swappie website.

“You” refers to the customer placing the order on the Swappie website.
“Terms and Conditions” refers to these terms and conditions.
“Swappie Warranty™” refers to the commercial warranty Swappie provides for its Devices and Accessories.
“Day” refers to a business day. Weekends and public holidays are not considered business days.

“FMI” refers to the Find Devices feature in Devices and Accessories (Find My iPhone, Find My iPad and Find My AirPods).
“IMEI” refers to the International Mobile Equipment Identity.

  1. How the Service Works

Swappie purchases and sells refurbished Devices and sells certain Accessories through its Website. Devices sold by Swappie are subject to a professional inspection, functionality check, and refurbishment process performed by Swappie’s qualified technicians. Devices are graded based on their cosmetic condition and fully tested to ensure they meet functional quality standards. Accessories are not refurbished and are sold as described on their respective product pages.

Swappie offers the following Services to consumer customers:

  • Buying from and selling to Swappie: You can buy refurbished Devices from Swappie and also sell Devices to Swappie through the Website.
  • Warranty coverage: Each Device comes with the Swappie Warranty™, which includes repair or replacement for eligible faults within the warranty period, as specified in Section 10. Accessories are covered by the Swappie Warranty™ as described in the section applicable to Accessories.
  • Customer support and technical assistance: Swappie provides help via its customer service channels for inquiries related to orders, warranties, and product functionality.
  • Trade-in services: You may also trade in eligible devices. For the terms and conditions applicable to Your trade in on Swappie’s website, please click here.
  • Secure checkout and delivery options: Swappie supports multiple payment methods and offers shipping to various locations. Delivery options and timelines are specified during checkout and outlined in Section 7.

All Services are provided subject to the limitations and conditions set forth in these Terms and Conditions.

  1. Customer Obligations

By placing an order on the Swappie Website, you confirm that you:

  • Are a consumer acting outside your trade, business or profession.
  • Are at least 18 years old and legally capable of entering into a binding agreement.
  • Have read and accepted these Terms and Conditions, along with the Privacy Policy.

You are obligated to provide Your full contact information when placing an order, including Your full name, accurate billing and shipping address, active telephone number and a valid email address. You are solely responsible for the accuracy of the information You provide Swappie.  Swappie is not liable for any delays, failed deliveries, or additional costs resulting from incorrect or incomplete information.

Swappie may contact you via email, SMS, or phone regarding order status, delivery, support inquiries, warranty issues or legal notices.

Customer data is collected and stored in accordance with Swappie’s Privacy Policy, which outlines how Your data is used to manage customer relationships and fulfill orders. 

Please note that we may use automated tools, including artificial intelligence-based systems, to help us process customer communications (such as summarizing, categorizing, or authenticating Your requests). These tools are used only to support our services.

  1. Products Sold

Swappie sells used and refurbished Devices and certain Accessories through its Website. The Devices are checked and refurbished by Swappie professionals before being placed on sale. Swappie grades the Devices based on their cosmetic condition. When placing an order, You will choose the desired model, colour, memory capacity, battery condition and condition category of the Device you wish to purchase. 

Accessories are not refurbished and are sold in the condition described on their respective product page. Accessories are not subject to cosmetic grading unless explicitly stated.

The Devices are used and refurbished, and Swappie does not guarantee the preservation of original water, dust, or splash resistance (IP67 or IP68 certification).

We make all reasonable efforts to accurately explain the condition, specifications, and appearance of our Devices and Accessories, but minor variations may occur.

Repairs and replacements of Devices are done with high quality parts, including third party parts. For more details on Your Device, please contact our customer service. All repairs are done to refurbish the Device as close to a new device as possible.

If you bought an iPhone XR, XS or newer, you may see messages such as “Important Message” or “Unknown Parts” in your lock screen, notification center or in settings. These messages might appear when Swappie has done repair work on Your Device and some components needed to be replaced. For more information, please visit our Help Center.

  1.  Prices

The prices of the Devices and Accessories include value added tax (VAT) when applicable. Refurbished Devices may be subject to a VAT margin scheme.

The prices do not include the delivery costs. The delivery cost is clearly indicated to You before placing the Order, and dependent on the delivery method used. 

Swappie reserves the right to cancel the Order in the event of a clear and material price error. This refers to a possible pricing error where the price of the product deviates so significantly and clearly from its normal price level that the average consumer would be considered to have understood the error in question. 

  1. Payment

You can choose one of the payment methods offered during our checkout process.The available payment methods may vary depending on your location and the partners we use.

The terms and conditions of each of these payment providers shall apply to purchases made using their services. Swappie reserves the right to deny and/or cancel any order. Furthermore, in case of payment issues on Your part, Swappie reserves the right to annul the sale and demand that You return the products immediately.

  1. Delivery

The currently available delivery methods are listed on Swappie’s website. You are solely responsible for providing Swappie and the delivery service provider with correct information for successful delivery when placing Your Order, including Your name, address and phone number in the correct format. Any issues arising from incorrect or incomplete information is Your responsibility.

The orders are typically processed within 1–2 business days after the automatic order confirmation has been sent. Once processed, the estimated delivery time ranges from 1–5 business days depending on the chosen delivery method and destination. The exact delivery options and estimated times will be shown during checkout.

Please note that weekends and public holidays are not counted as business days.

The delivery times are estimates and are dependent on the delivery service provider. Swappie aims to process all orders in the time frame above where possible. However, Swappie is not responsible for any delivery delays that are beyond its reasonable control, including, but not limited to, incorrect information provided by You when placing the order, strikes, weather conditions, epidemics, quarantines or shortages of transportation fuel, energy or labour.

In case You receive an incorrect or damaged Device or Accessory, please contact our customer service as soon as reasonably possible. Swappie reserves the right to demand additional payment on the return of the incorrect or damaged product.

  1. Returns

You have the statutory right to withdraw from the purchase and return the Device or Accessory within 14 days of receiving Your Order. To exercise this right, You must notify Swappie of Your decision to withdraw within 14 days of receiving the Device or Accessory. This can be done by filling in the return form here or by contacting Swappie’s customer service. By sending us the form or contacting customer service, You officially notify us of Your withdrawal.

After giving notice of withdrawal, You must return the Device or Accessory to Swappie within 14 days. You may handle and inspect the Device or Accessory as you would in a physical store in order to determine its nature, characteristics and functioning. Where reasonably possible, the product should be returned with its original sales packaging, all accessories included in the sales package, and any complimentary items. 

If the Device or Accessory has been handled beyond what is necessary to establish its nature, characteristics and functioning, You are responsible for any resulting diminished value. Swappie may deduct from Your refund an amount corresponding to the diminished value of the Device or Accessory where applicable. In the case of Devices, Swappie may alternatively offer a paid repair service at Your expense.

We will proceed with the refund payment within 14 days from the date of Your withdrawal notice and when You have handed in the return to the shipping company. Swappie will issue a refund using the same payment method used for the original purchase. The refund payment will appear in Your bank account within five (5) business days from Swappie’s payment. In some cases, such as during public holidays or for other reasons, the refund process may take longer. If Swappie is unable to issue a refund using the same payment method used to make the purchase, the refund will be issued via an alternative method acceptable to You.

You are responsible for ensuring that the Device or Accessory is carefully and securely packaged to prevent any damage during transit. The products are to be sent to us at the address and via the delivery service provider and manner specified in the instructions. If You are returning the Device or Accessory from a country outside the European Union, You are required to cover all associated shipping and customs costs. Until the Device or Accessory is delivered and received by Swappie, it remains Your responsibility and liability. 

Before sending Your Device or Accessory to Swappie, You are required to make sure that Find Devices (FMI) is disabled. This feature is part of Apple’s security system, and as long as it is active, the Device or Accessory remains locked to your personal Apple ID. We cannot process Your return or refund until FMI has been disabled. If the Device or Accessory is returned with FMI still active, your refund may be delayed, and Swappie may charge You additional delivery and/or service costs resulting from this issue. Swappie reserves the right to return the Device or Accessory to You if you fail to turn off the FMI within one (1) month after Swappie contacting You. In this case, Swappie will send the Device or Accessory back to you and not refund the Device or Accessory. If You fail to collect the Device or Accessory, We will not take any further responsibility for the Device or Accessory.

  1. Legal Guarantee

You have a one year statutory defect liability right under applicable consumer protection laws (the  “Legal guarantee”). This is Your right under consumer law and sets the minimum level of protection You are entitled to. It applies independently of, and in addition to, the Swappie Warranty™ (Our commercial warranty).

If You detect a fault in the product that existed at the time You received the product and is not caused by misuse or mishandling the product, You must notify Swappie about it as soon as reasonably possible after discovery. Notifying Swappie is to be done via email, or the contact form in our Help Centre. Upon notifying us and having received instructions on how to proceed, the faulty product is to be sent to Swappie at the address and via the delivery service provider and manner specified in the instructions within a reasonable time.

If You receive a product that is not in accordance with the product specifications, please inform us as soon as reasonably possible.

Upon receiving the returned product, Swappie reserves the right to inspect and verify the reported fault. Please allow 3–5 business days for this assessment to be completed before any refund or further action is taken.


If the product is found to be defective under the Legal Guarantee, Swappie will, free of charge:

  • repair the product, or
  • replace the product with an equivalent model, or
  • where repair or replacement is not possible, provide a price reduction or refund.
  1. Swappie Warranty™ 

In addition to your statutory rights under the Legal Guarantee, Swappie provides a voluntary 12-month Swappie Warranty™ for Devices and certain Accessories sold through its Website. The Swappie Warranty™ is a commercial warranty and does not limit or replace your statutory rights.

The scope of the Swappie Warranty™ depends on the product category as described below. These warranty terms separately specify the situations in which the Swappie Warranty™ is void, as well as the specific components and types of damage that are not covered by the Swappie Warranty™.

Swappie Warranty™ Coverage

The period of validity for the Swappie Warranty™ is 12 months, starting from the purchasing date.

Please note that Devices and Accessories sold by Swappie are not covered by Apple’s limited warranty or any AppleCare plan(s).

Devices 

For Devices, the Swappie Warranty™ period for the Device’s battery is limited to 12 months, starting from the purchasing date. You are obligated to familiarise Yourself with these warranty terms of the Device before taking the Device into use.

If a fault covered by the warranty is detected, Swappie will either:

  • Repair the Device at no cost to you, initiating the repair process within 24 hours of registering the Device in our system after its arrival; or
  • Replace the Device. If We are unable to return the Device to its earlier condition, We will replace the Device with another of the same model and cosmetic condition. 

Accessories

For Accessories (AirPods), the Swappie Warranty™ is limited to replacement of the product. Repair services are not provided for Accessories.

If you wish to make a claim under the Swappie Warranty™ for an Accessory, you must return the product to Swappie in accordance with the instructions provided. Swappie may request photos or additional information before authorising the return.

Once the returned Accessory has been assessed and the fault confirmed, Swappie will provide a replacement Accessory of the same model. The replacement may be new or equivalent in condition.

If the reported fault is not covered by the Swappie Warranty™, Swappie will inform you of the outcome and return the Accessory to you.

Exclusions from Swappie Warranty™ Coverage for Devices

If it is determined that the Device’s fault has been caused by You, Swappie is not liable for it. Such causes include, for example, causing physical damage to the Device, using the Device contrary to its instructions, or other negligent actions. Especially, please note the following: 

  • Normal wear and tear of the Device and battery are not covered by the Swappie Warranty™.
  • The screen breaking or cracking is not covered by the Swappie Warranty™.
  • Software faults are not covered by the Swappie Warranty™.
  • Removing viruses or other malware from the Device is not covered by the Swappie Warranty™.
  • Damage to the Device caused by failure to follow instructions and/or relating to improper or unusual use of the Device is not covered by the Swappie Warranty™. 
  • Physically opening the Device will void the Swappie Warranty™.
  • Damage to the Device during shipment due to Your negligence is not covered by the Swappie Warranty™. You are responsible for properly packing the Device for shipping.
  • The Swappie Warranty™ is voided if the Device’s serial number or IMEI has been removed or otherwise made unreadable.
  • Other indirect or purely financial damages caused by the breakage of the Device, such as the destruction or corruption of data files, are not covered by the Swappie Warranty™.
  • The Swappie Warranty™ is voided if the Device’s glass/home button/camera/other features have broken due to, for example, improper and/or unusual use, such as the Device having been dropped or having hit something.
  • The Swappie Warranty™ is voided if a Device bought from Swappie has been repaired by You or a third party without the written consent of Swappie.
  • The Swappie Warranty™ is voided if the Device is bent, has water damage, or if any features have broken due to improper use, such as the Device having been dropped or having hit something.

Exclusions from Swappie Warranty™ Coverage for Accessories

For Accessories, the Swappie Warranty™ does not apply if the damage was caused by you, for example through improper use or accidental damage. For Accessories, the Swappie Warranty™ does not apply to:

  • normal wear and tear;
  • damage caused by improper use, accidents, negligence or external impact;
  • damage resulting from unauthorised repair or modification.

Replacement and Swappie Warranty™ Continuity

If You receive a replacement Device or Accessory, the Swappie Warranty™ continues to be valid from the date of the original purchase. If You sell Your Device or Accessory to a new owner within the warranty period, You are responsible for informing Swappie about the ownership change to ensure that the new owner is eligible for the Swappie Warranty™. 

  1.  Repair process (Devices Only)

To send Your Device to warranty repair, please fill in the warranty form here. Once the form has been submitted, You will receive confirmation and instructions on how to proceed. Swappie may request photos of the Device before You send the Device in for warranty repair.

You are responsible for backing up the files on the Device before sending it in for repair. You are responsible for packing the Device in a careful and protective manner. The Device is to be sent to Swappie at the address and via the delivery service provider and manner specified in the instructions. 

Please do not send any accessories with Your Device when sending it to warranty repair. Swappie does not guarantee the return of accessories sent to our warranty service.

Swappie will provide You with a prepaid shipping label for Devices sent in for warranty repair. You are responsible for the Device until it has been delivered to Swappie. If the Device is delivered and returned so that it is marked as fragile, meaning that the handling of the Device requires special measures, You are liable to pay for the incurred delivery costs.

If You send the Device to us for warranty repair from a country outside the European Union, You are responsible for covering all associated shipment and customs costs.

Accessories are not eligible for repair services. If an Accessory is covered under the Swappie Warranty™, Swappie will provide instructions for return and replacement.

Find Devices (FMI) must be disabled

Before sending your Device or Accessory to Swappie, You must disable the Find Devices (Find My iPhone, Find my iPad, Find my AirPods) feature on Your Device  or Accessory. FMI is part of Apple’s security system, and as long as it is active, the Device or Accessory is locked to Your personal Apple ID. Swappie cannot proceed with any repair or provide a replacement Device  or Accessory  while FMI remains active. Swappie reserves the right to return the Device  or Accessory to You and charge the delivery costs, in cases where You were or should have been aware that the FMI feature is on and not turned off within one (1) month after contacting you. In this case, Swappie will send the Device or Accessory back to you and not begin the warranty repair process or send a replacement product to you. If You fail to collect the Device or Accessory , We will not take any further responsibility for the product.

Repair Timeline and Outcomes (Devices Only)

Swappie’s repair service will assess and, if possible, repair the identified fault. If the availability of spare parts is poor, the parts are unreasonably expensive or the Device otherwise proves to not be worthy of repair, the Device in question will be replaced with another unit of the same model and condition. The cosmetic condition of the replacement Device will reflect the cosmetic condition of the Device that was sent to Swappie for warranty repair. Swappie’s warranty repairs take, on average, seven (7) business days to complete, counted from the Device’s date of arrival to our facilities. In some cases, such as during public holidays or for other reasons, the repair process may take longer. In order for the Device to be repaired within a reasonable time, the quality of the Device, availability of spare parts, quality and extent of the fault or other special technical properties must also be taken into account. Swappie may agree to a price reduction or refund if repairing the fault is not worth it, the fault is minimal or if the Device cannot be repaired.

Accessories are not eligible for repair services and are handled in accordance with the Swappie Warranty™ section applicable to Accessories.

Paid Repair Services (Devices Only)

Swappie offers paid repair services in cases where the Swappie Warranty™ is expired or the warranty is voided. In these cases Swappie will offer a free fault diagnosis and an estimate of the cost of the repair. In cases where the Swappie Warranty™ is voided and a paid repair is done on the Device, the replaced parts of the Device have a 12-month Swappie Warranty™. You may request an official statement from Swappie on the specifics of the required repair for your insurance provider. The cost of this statement is €40. 

  1. Terms and Conditions of the Trade-In

  1. Limitation of liability

Nothing in these Terms shall exclude or limit Swappie’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

Devices are second-hand and sold as they are. The condition and characteristics of the Devices are described on its respective product page under the condition category. By selecting the condition of the Device you explicitly acknowledge and accept the described characteristics. Accessories are sold in the condition described on their respective product page.

Swappie is not liable for any indirect costs which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the products or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity, strikes, epidemics or quarantine. Swappie’s maximum liability to You for any loss or damage arising in connection with Your order on Swappie’s website shall be limited to the total price of Your order.

Liability for defects in the product is strictly limited to the possible refund of the purchase price of the Device minus the benefits received.

Swappie does not provide original purchase receipts from the original owner of the Device and is not liable to do so. 

Certain functions or services available on the Devices sold by Swappie may require creating and maintaining a user account with the original equipment manufacturer (OEM) (for example Apple ID for Apple Devices). You are responsible for all activity occurring on Your OEM account and for securing Your account information, including Your password. You must never use someone else’s OEM account or password without the permission and agreement of the account holder. Swappie cannot and will not take any liability for the loss or damage that is caused by neglecting these responsibilities. Swappie is not liable for forgotten  account credentials (such as Apple IDs or passwords). In cases where Swappie cannot access the Device in order to repair it or issue You a refund due to a forgotten OEM account or password, Swappie will return the Device to You.

14.  Changes to the Terms & Conditions

We reserve the right to amend these Terms from time to time without prior notice to You. The version of the Terms that will apply to Your order will be those on Swappie’s website at the time You place Your order.

15. Applicable law and dispute resolution

These Terms are governed by the laws of the Czech Republic. In case of complaints, please contact Swappie at info@swappie.com. If You are not satisfied with Swappie’s resolution to Your complaint, You can file a complaint with Your local consumer protection agency.
