Swappie Terms & Conditions
These terms and conditions apply to Buyback Trade-In -service provided by Swappie for consumer customers. If You are not a consumer customer, please contact us at info@swappie.com.
By selling your Phone to Swappie, You agree to be bound by the terms and conditions set out herein. Please make sure You have read and understood these terms and conditions before selling Your Phone to Swappie.
1. Definitions
“Swappie” refers to Swappie Oy (business ID 2692328-4, address Itämerenkatu 3 A, 00180 Helsinki, Finland).
“You” refers to the seller of the Phone to Swappie in a physical store.
“Phone” refers to the device being sold by You to Swappie.
“Terms” refers to these terms and conditions.
“Service” refers to the Buyback Trade-In -service provided by Swappie in a physical store. Through the service You receive a voucher for selling the Phone to Swappie.
“Payment” refers to the voucher You receive for the Phone sold to Swappie, which can be subsequently used to buy a phone and/or complementary products in the physical store unless otherwise stated.
“Swappie Warranty” refers to the commercial warranty Swappie provides for its phones.
“Day” refers to a business day. Weekends and public holidays are not considered business days.
“FMI” refers to the Find My iPhone feature in Apple iPhones.
“IMEI” refers to the International Mobile Equipment Identity.
2. Customer
By assigning your Phone to the Service, You agree to be bound by these Terms.
You are obligated to give Your full contact information when utilising the Service, including Your name, billing and shipping address, active telephone number and email address. You are solely responsible for the accuracy of the information You provide Swappie and are liable for any and all costs caused by giving incorrect contact information.
By assigning your Phone to the Service, You confirm that You are the owner of the Phone(s) and have the full right to sell and profit from them. If You’re willing to sell more than 5 Phones at the same time, Swappie reserves the right to ask for further details regarding the ownership of the Phones.
By assigning your Phone to the Service, You confirm that You are of the required legal age to sell and profit from the Phone(s) You attempt to sell to Swappie. If You are under the required legal age, You have obtained Your parent’s or guardian’s consent to sell Your Phone(s) to Swappie for the estimated sum.
Customer data is stored in Swappie’s customer register and is used for maintaining and managing customer relationships. More information about the processing of personal data can be found in Swappie’s Privacy Policy, which is available on Swappie’s website.
3. Phone
Once the Phone is admitted to the service, the ownership of the Phone is immediately transferred to Swappie. After this, you do not have the right to demand the admitted Phone back.
Swappie does not buy Phones that are water damaged, bent, have problems suggestive of motherboard issues, have a faulty Touch ID, have the FMI feature on, have non-functional Face ID or True Tone, have an irreparable crack in the Home button, Phones that have been manufactured for Japan, China or Middle Eastern countries, or Phones that have been previously disassembled and reassembled with spare parts that do not meet Swappie’s standards.
Swappie does not buy stolen Phones. We will check the legal status of the Phone from the internationally compiled CheckMEND database. If the phone turns out to be Blacklisted Swappie will notify the police and You by email (Exceptions, Section A).
The Phone must be an Apple or an Android product.
Requirements of an Almost New Phone
- All the features of an Almost New Phone must be fully functional.
- The body of the Phone must be intact and not cracked or showing any signs of use.
- All intact Phones must adhere to the following criteria:
- The Phone must turn on and off normally.
- The Phone has a battery, and back cover/glass with no scratches.
- The Phone must not be water or fire damaged.
- The screen must be intact and fully functional, and it must not contain cracks, any bright spots, darker areas or other colour blotches.
- The Phone must not be bent.
- The Phone must have all original parts in it.
- The Phone’s biometric sensor (Touch ID / Face ID) must work.
- The screen glass, frame and touch screen sensor are intact.
- The display frame must correspond to the original, e.g., a model of a particular colour must have a display matching that colour.
Definition of a Broken Phone
The screen glass and/or touch screen is broken or the display has dead pixels. In addition, the Phone may also have other faults from the following list:
- A faulty battery (the Phone does not turn on).
- The Phone’s screen is loose.
- There is no sound coming from the speakers or when an AUX plug is connected to the Phone.
- One or more of the microphones do not work.
- The home, volume, mute, or power button does not work or works poorly.
- The front camera does not work or works poorly.
- The back camera does not work or works poorly (focus issues, shakiness, or visible dark spots in the rear lens).
- The rear or front camera lens is cracked.
- The proximity sensor does not work.
- The back glass and/or frame is cracked.
- There is a software error showing on the “Hello” screen (iTunes won’t connect to the Phone or reset factory settings).
- The charging port is faulty (the Phone does not charge or the port is loose/ malformed).
- The Phone does not recognise SIM cards.
- The vibration does not work.
- The Phone has missing parts.
- The force touch feature does not work.
- The camera flash does not work.
- The Phone is able to charge, but it does not connect to a computer (“No data” fault).
- If the replacement screen of the Phone does not meet Swappie’s standards or is not an original.
Note! Even if the Phone is completely broken, it may still have a sale value if the motherboard is undamaged.
Definition of a Recyclable Phone
By default, a Phone that cannot be categorised in any of the aforementioned condition categories will fall into the category of Recyclable. More specifically, if the Phone presents one or more of the following faults, it will automatically be graded as Recyclable:
- The Phone shows problems suggestive of motherboard issues:
- The Phone does not connect to the network (WiFi).
- The Phone does not record audio files in any format.
- The “No service” message on the cellular indicator is showing permanently.
- The Phone has non-functional GPS / Compass (“Gyro”).
- If the battery is replaced by a third party in models XR, XS and above and displays the“Important Battery Message”.
- The Phone is water damaged.
- The Phone is bent.
- The Phone has a non-functional Touch ID, Face ID or True Tone.
- Bluetooth does not work.
- For iPhone models 11 and above, if the screen is not original and shows the “Important Display Message”.
- Wireless charging does not work.
- The Home button is cracked.
- The Phone is operator locked. Operator-locked Phones cannot be purchased by Swappie. Swappie can offer €5 to recycle them. Swappie cannot act on Your behalf and contact the operator in order to unlock the Phone, due to Swappie’s GDPR agreement.
- The Phone has been manufactured for Japan, China or Middle Eastern countries.
- The Phone is an iPhone 7 Model A1660.
Other categories
For iPhone models 6s Plus, SE (2016), 6s and below, Swappie does not offer any compensation, regardless of the state of the Phone.
Exceptions
1. Blacklisted Phones
If the Phone is found to have a record that indicates it has been lost or stolen, or Swappie becomes aware of any other issues related to its ownership (e.g. Blacklisted), Swappie will notify You by email and quarantine the Phone for an initial period of 14 days (“the Quarantine Period”).
In such circumstances ,You will be required to contact the seller, the store, the carrier provider or the third party that sold You the Phone to prove that You are the rightful owner of the Phone, have the lost or stolen records associated with it cleared within the Quarantine Period, and resolve any other issues relating to its ownership.
If the Phone is not cleared in the CheckMEND database within the Quarantine Period, Swappie will hand it over to the police or other law enforcement body, and by entering into this contract, You expressly agree to this action.
If You have received Payment from Swappie for a Phone, which Swappie subsequently becomes aware of an issue relating to ownership, You agree to immediately reimburse Swappie in full, within 3 business days following a written request by Swappie, for any such payment pending an investigation by Swappie or any law enforcement body into the ownership of the Phone.
If Swappie at any time becomes aware of any issues relating to the ownership of the Phone, You agree to cooperate with Swappie fully with a view to resolving the issue. This may or may not require contact with the police and/or other law enforcement authorities.
2. MDM (Mobile Device Management) locked Phones
MDM-locked Phones refer to the condition of a mobile device that is corporate-owned and is monitored and managed by corporate security software, normally a company or corporation. MDM-locked devices cannot be purchased by Swappie under any circumstances, because You do not own the rights to sell or profit from the device. You agree to immediately reimburse Swappie in full, within 3 business days following a written request by Swappie, for the MDM-locked Phones.
4. Payment
Swappie will pay you for the Phone admitted under the Service with a voucher worth the price estimate based on the condition of the Phone. The value of the voucher for the Phone is based on the Phone’s model, memory and condition.
The voucher must be used to buy a Swappie phone and/or complementary products in the physical store unless otherwise stated. The voucher must be used at the time when the phone is assigned to Swappie. The voucher received for admitting the phone to Swappie has to be used in its entirety at once. If you buy a phone that costs less than the amount credited by the voucher, the surplus amount is non-refundable.
If the price of the chosen phone exceeds the value of the voucher, you are obligated to pay the difference.
Once the payment has been forwarded, You have released your right to pursue any claims regarding the ownership of the device.
5. Products
Swappie sells used and refurbished mobile phones. The mobile phones are checked and refurbished by Swappie professionals before being placed on sale. Swappie grades the mobile phones based on their aesthetic condition.
Swappie also sells accessories for the mobile phones, such as tempered glasses and phone cases.
6. Prices
The prices of the products include value added tax (VAT) when applicable. Used mobile phones are often subject to a VAT margin scheme. Swappie has the right to update prices in accordance with the current market price changes.
7. Returns
Products which are paid for by a voucher cannot be returned. You have 14 days to exchange products that are paid for by a voucher.
Swappie guarantees exchange for any products, provided that all products are in the same condition they were in upon Your receipt. If the products are damaged in any way, Swappie will either not accept the products or offer a paid repair service for them.
To exchange Your products, please visit a Swappie store.
8. Liability for defects
You have a statutory guarantee for the products You purchase. In case You detect faults in the products that existed at the time You received the products and are not caused by mishandling the products, You must inform Swappie about them as soon as possible after they have been detected. Notifying Swappie is to be done via email, telephone, the contact form in our Help Centre or the chat service on Swappie’s website. Upon notifying us and having received instructions on how to proceed, the faulty product is to be sent to us at the address and via the delivery service provider and manner specified in the instructions within a reasonable time.
Swappie reserves the right to verify the faults reported in the products and 3–5 business days must always be reserved for this process before any possible refund may take place.
9. Swappie Warranty™
Swappie provides a 12-month Swappie Warranty™ for all phones. Any detected faults covered by the Swappie Warranty™ will be repaired by Swappie. These warranty terms separately specify the cases in which the Swappie Warranty™ is void and those parts of a phone that are not covered by the Swappie Warranty™.
The period of validity for the Swappie Warranty™ is 12 months, starting from the purchasing date. The warranty period for the phone’s battery is limited to 12 months, starting from the purchasing date. You are obligated to familiarise Yourself with these warranty terms of the phone before taking the phone into use.
The following services are included in our warranty:
- Guaranteed fast repair service. Upon receiving the phone, we will begin the repair process within 24 hours.
- Replacement device. If we are unable to return the phone to its earlier condition, we will replace it with another unit of the same model and aesthetic condition.
If it is determined that the phone’s fault has been caused by You, Swappie is not liable for it. Such causes include, for example, causing physical damage to the phone, using the phone contrary to its instructions, or other negligent actions. Especially, please note the following:
- Normal wear and tear of the phone and battery are not covered by the Swappie Warranty™.
- The screen breaking or cracking is not covered by the Swappie Warranty™.
- Software faults are not covered by the Swappie Warranty™.
- Removing viruses or other malware from the phone is not covered by the Swappie Warranty™.
- Damage to the phone caused by failure to follow instructions and/or relating to improper or unusual use of the phone is not covered by the Swappie Warranty™.
- Physically opening the phone will void the Swappie Warranty™.
- Damage to the phone during shipment due to Your negligence is not covered by the Swappie Warranty™. You are responsible for properly packing the phone for shipping.
- The Swappie Warranty™ is voided if the phone’s serial number or IMEI has been removed or otherwise made unreadable.
- Other indirect or purely financial damages caused by the breakage of the phone, such as the destruction or corruption of data files, are not covered by the Swappie Warranty™.
- The Swappie Warranty™ is voided if the phone’s glass/home button/camera/other features have broken due to, for example, improper and/or unusual use, such as the phone having been dropped or having hit something.
- The Swappie Warranty™ is voided if a phone bought from Swappie has been repaired by the customer themselves or a third party without the written consent of Swappie.
- The Swappie Warranty™ is voided if the phone is bent, has water damage, or if any features have broken due to improper use, such as the phone having been dropped or having hit something.
If You receive a replacement device, the Swappie Warranty™ continues to be valid from the date of the original purchase date. If You sell Your phone to a new owner within the warranty period, You are responsible for informing Swappie about the ownership change to ensure that the new owner is eligible for the Swappie Warranty™. Warranty extensions are not transferable and are only applicable to You as the original purchaser.
Swappie reserves the right to charge 25€ for the delivery costs in cases where You were or should have been aware that the warranty is voided or Find My iPhone is on. In addition, Swappie reserves the right to request photos of the phone before You send it in for warranty repair.
These warranty terms are applicable to the 3-year warranty extension as well. The 3-year warranty extension begins from the purchasing date.
10. Repair process
To send Your phone to warranty repair, please fill in the warranty form on Swappie’s website https://swappie.com/en/returns/.
You are responsible for backing up the files on the phone before sending it in for repair. You are responsible for packing the phone in a careful and protective manner before sending it to Swappie. The phone is to be sent to us at the address and via the delivery service provider and manner specified in the instructions. You are responsible for the phone until it has been delivered to Swappie. If the phone is delivered and returned so that it is marked as fragile, meaning that the handling of the phone requires special measures, You are liable to pay for the incurred delivery costs.
You are required to make sure that Find My iPhone has been disabled from the phone before sending it to Swappie. Swappie will not be able to repair the phone or offer a replacement device before Find My iPhone has been disabled.
The detected fault will be repaired by our repair service. If the availability of spare parts is poor, the parts are unreasonably expensive or the phone otherwise proves to not be worthy of repair, the phone in question will be replaced with another unit of the same model and condition. The aesthetic condition of the replacement phone will reflect the aesthetic condition of the phone that was sent to Swappie for warranty repair. Swappie’s warranty repairs take, on average, only 5 business days to complete, counted from the date of arrival to our facilities. In some cases, such as during public holidays or for other reasons, the repair process may take longer. In order for the phone to be repaired within a reasonable time, the quality of the phone, availability of spare parts, quality and extent of the fault or other special technical properties must also be taken into account. Swappie may agree to a price reduction or refund if repairing the fault is not worth it, the fault is minimal or if the phone cannot be repaired.
Swappie offers paid repair services in cases where the Swappie Warranty™ is expired or the warranty is voided. In these cases Swappie will offer a free fault diagnosis and an estimate of the cost of the repair. In cases where the Swappie Warranty™ is voided and a paid repair is done on the phone, the replaced parts of the phone have a 12-month Swappie Warranty™. You may request an official statement from Swappie on the specifics of the required repair for your insurance provider. The cost of this statement is €40.
11. Limitation of liability
Nothing in these Terms shall exclude or limit Swappie’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
Products are sold as they are. Swappie is not liable for any indirect costs which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the products or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity, strikes, epidemics or quarantine. Swappie’s maximum liability to You for any loss or damage arising in connection with Your purchase of a Swappie’s product in connection with the Service shall be limited to the total price of Your order.
The product liability for defects is limited to the possible refund of the purchase price of the product minus the benefits received.
Swappie does not provide original purchase receipts from the original owner of the phone and is not liable to do so.
Certain functions or services available on the phones sold by Swappie may require opening an Apple user account (including setting up an Apple ID user and password). You are responsible for all activity occurring on Your account and securing Your account information, including Your password. You are forbidden at all times to use someone else’s Apple ID, password or account without the permission and agreement of the account holder. Swappie cannot and will not take any liability for the loss or damage that is caused by neglecting these responsibilities. Swappie is not liable for forgotten Apple IDs or passwords. In cases where Swappie cannot access the phone in order to repair it or issue You a refund due to a forgotten Apple ID or password, Swappie will return the phone to You.
12. Changes to the Terms & Conditions
We reserve the right to amend these Terms from time to time without prior notice to You.
13. Applicable law and dispute resolution
These Terms are governed by Finnish law. In case of complaints, please contact Swappie at info@swappie.com or +353 1 903 8690. If You are not satisfied with Swappie’s resolution to Your complaint, You may seek advice from the Finnish Competition and Consumer Authority. Any disputes, controversies or claims arising out of or relating to these Terms shall be settled in the Helsinki District Court.
